Selling a Home
When you decide to sell your property, you should instruct a solicitor from the outset. This will make for a smooth transaction, allowing the solicitor time to ensure all the relevant documentation is in place. For example, if you have added an extension to your property, you should ensure that you have the proper planning permissions, as prospective buyers will expect to see this. You will also need to arrange for a Home Report to be prepared, which lets potential buyers know important information about a property.
You should also consider the financing of any proposed move carefully. Check to see what your outstanding mortgage is on your current property. You should speak to your solicitor about land registration and tax costs of any move so that these additional costs are budgeted for.
Buying a Home
On the other side of the process, if you are looking to buy a property, you will need to submit an offer for the relevant property. Once you and the seller agree on the terms a contract will be formed. This is called missives The seller will sign a disposition which transfers ownership from the seller to the buyer and which is registered in the Land Register of Scotland.
Your solicitor can also assist in discharging your current mortgage and registering the new mortgage (legally known as a ‘standard security’) against your property.
The process is paperwork and negotiation heavy. This is why it is crucial that you have a solicitor acting for you who will absorb this burden and ensure a smooth process with a positive outcome.
