A law firm for life

Business and Contract Disputes: Dispute Resolution

At The McKinstry Company, we work with a wide variety of businesses including manufacturing, retail and the service industries, as well as in the agricultural and farming sectors.  We have particular expertise in working with family businesses and in representing clients in disputes and litigation.

Contractual relationships are at the heart of any business relationship.  When these relationships breakdown, it can be challenging to see how disputes can be resolved.  This is where we come in.  Our team of experienced negotiators and litigators are best-placed to establish what outcome you want and how to get there.  We are strategic in our approach and will seek to assist in the most commercial and pragmatic way possible.  If you are involved in a contractual dispute – don’t let it fester.  Get in touch with our team today, who are always happy to assist. Contact us on 01465 915021 or complete our online enquiry form.

What is Dispute Resolution?

Clients often assume that the only option available when they are involved in a dispute is to go to court.  While this is one option, it is not the only option, and may not be the option best-suited to your dispute.  We can help you assess the dispute and advise on the best route forward.

For example, if you are dealing with bad debt, it may be sufficient for our team to send a letter requesting payment to the other party.  It may also be possible to negotiate a payment plan with them, ensuring that you receive the funds owed to you.  Alternatively, if other routes are not appropriate or have been exhausted, we may need to raise an action in court.  Depending on the sums owed, we can advise on how to raise the action and what the prospects of success are.  We will prepare the court papers and present your case on your behalf.

While this may seem very daunting, we ensure that there is minimal disruption to your business.  We understand that the process is stressful and we are here every step of the way to make sure you get the right result.
