Can I make a personal injury claim?

The first step in making a personal injury claim is to contact an experienced solicitor. They will be able to let you know the likelihood of your claim succeeding. Generally, you must have been injured as a result of an accident that was not your fault, within the last three years in order to bring a successful claim. There are exceptions to this, so it is always best to speak to a specialist.

What is the process for making a personal injury claim?

After your initial consultation if we consider your claim has reasonable prospects we will carry out a full investigation into your accident and pursue the case aggressively to secure an admission of fault from the other side.  This will generally come from the insurers acting on the other side.  Once this admission has been secured we will ask for further details about what happened to you. We will, in due course, also seek to determine how much compensation might be owed to you for your injuries. There are detailed guidelines and court judgements which inform how much you can claim, and the exact amount will depend on the nature and severity of your injury. We will also set out how much you are owed to compensate you for financial loss, such as loss of earnings, loss of future earnings, medical and care costs and any other expenses.

Once we have set out your claim, we will begin gathering evidence to support it. The evidence we might need can include; photos of the accident site, photos of your injuries, medical reports, any accident book that may be available, witness statements, and anything else which we feel might support your claim.

We will then begin negotiations with the other party around liability and settlement.

What if I need rehabilitation?

While we have a wonderful NHS with doctors and nurses able to provide amazing treatment often rehabilitation such as physiotherapy is hard to organise through the NHS with waiting times for local providers often impacting on your recovery.  In many circumstances we are able to organise physiotherapy and other rehabilitation you may need at an early stage with expert providers ensuring your route to recovery is as speedy as possible.

Will I have to go to court?

Most personal injury cases settle out of court, which is why it is essential to instruct an experienced solicitor with expert negotiating skills. Only an expert will know all of the ways in which you should be compensated for your loss, and secure maximum financial compensation for you.
