What happens when driving goes horribly wrong?

It is fair to say that driving in a straight line should not pose any difficulties and only manoeuvres are likely to put you and others into harm’s way. Add to that your most expensive asset is damaged by someone’s negligence and you simply don’t know what to do. Recently this came into sharp focus when a delivery driver for a major supermarket carried out a manoeuvre which, in itself, is not too dangerous, but can easily become so if not carried out with the necessary checks or skill of a competent driver.

The result was a crash between his van and petrol tanker carrying aviation fuel. The tanker left the road and discharged thousands of gallons of fuel into the garden and home of the innocent homeowner. Both drivers were to blame, with the supermarket driver being 75% to blame and the tanker driver 25% to blame. Sadly, the tanker driver was fatally injured.

The family were out of their home for two years and had all the upheaval and upset caused by this unfortunate accident. Regrettably, the family were not able to secure appropriate compensation without taking the case to court but at a hearing in the Court of Session judgement was eventually given in their favour.
