A law firm for life

Wills & Estates

Your local wills and estates experts.

Our Private Client team, led by Partner Thiona McQuiston, can give you expert advice on all aspects relating to Wills and Estates. In line with other areas of the firm, we have recruited and trained outstanding solicitors to ensure you receive the best possible service. Stephen Neillie and Debbie Dunlop are experienced private client solicitors who have gone the extra mile and successfully completed the onerous examinations of the Society of Trust and Executry Practitioners.

Writing a Will is one of the most important decisions you will make. It gives you full control over what happens to your estate and how it is divided up. It also means when the time comes to administer your estate, it is a much quicker and easier process. This can help to minimise the upset for your family, as well as keep costs down.

On the other hand, without a Will, the law dictates who receives your estate and in what proportions. Unfortunately, this may not be how you would have chosen to do it, or had assumed would happen – without a Will, your spouse, partner or children may not automatically inherit.

We understand having to talk about these things can be difficult. However, our Private Client team is highly experienced in this area and can talk to you professionally and sensitively about any aspects of writing your Will. With our expertise and knowledge, we can make sure the best arrangements are put in place to benefit your family and loved ones.

Powers of Attorney

A Power of Attorney protects you against a situation in the future where you can no longer make decisions for yourself about your finances or welfare. It is a bit like having an insurance policy, which will allow your family or loved ones to step in and make decisions on your behalf, should you lose capacity to do so, for example, due to dementia or an accident. By choosing a Power of Attorney, you are stating who you want to manage your money and help with your care. We recommend everyone has one.

The process of making a Power of Attorney is quick and simple. We can guide you through the process from start to finish, giving you peace of mind that, if needs be, your affairs will be properly handled by someone you trust.

Guardianship is the alternative to a Power of Attorney – unfortunately, it is a costly and intrusive process. A Guardianship Order is required when an individual loses capacity and needs someone to make decisions on their behalf about their finances or welfare, but did not previously appoint a Power of Attorney.

We can advise you on the whole Guardianship process, which requires an application to the court and the involvement of doctors and social workers.

Older Client Services

As you grow older, life can present new challenges. We have a wealth of experience in dealing with older client issues and can help you successfully plan for the future. That could be in relation to asset or wealth protection, advice on Inheritance Tax, protection from care home costs or another issue.

If you have issues you would like to discuss, we would be delighted to meet with you. All our offices have ground floor access with facilities for wheelchairs, or we can visit you at home.

To arrange a meeting, please contact our Private Client team on 01292 281 711.

Estate Administration

We understand how difficult it is to deal with the passing of a loved one, and the challenges bereavement presents.

We can help you with all matters arising from bereavement, handling everything professionally, sensitively and efficiently on your behalf. This could be investigating an estate, obtaining Confirmation, distributing the estate among the beneficiaries or another related matter. Whatever the issue, we would be glad to help.
